HB 58 -- MOTOR VEHICLE RECORDS (Thomason)

This bill requires the Department of Revenue to provide a method
for individuals to prevent the disclosure of personal
information about them contained in Department of Revenue
records.  Personal information includes an individual's
photograph, social security number, and name and address.  It
does not include information about an individual's accidents and
driving violations.

A notice that information may be disclosed and that the
individual has the right to prohibit such disclosure must be
printed on all forms for renewal of vehicle titles, vehicle
registrations, and driver's licenses.  Personal information in
bulk disclosures can only be used for surveys, marketing, and
solicitations.  Any person wishing to disseminate individual or
bulk motor vehicle records may obtain them from the Department
of Revenue in electronic form.

FISCAL NOTE:  Estimated Net Cost to Highway Fund of $204,194 for
FY 1998, $2,042 for FY 1999, and $2,042 for FY 2000.  Estimated
Net Loss to Information Fund of $404,000 for FY 1998, FY 1999,
and FY 2000.

Administrative Law by a vote of 14 to 2.

PROPONENTS:  Supporters say that the bill provides a method for
individuals to protect themselves from the dissemination of
personal information contained in Department of Revenue records.
In addition, the bill puts the state in compliance with federal
law.  The state penalty for noncompliance is $5,000 per day.
